Ownership of Your Content

Postsbin does not claim ownership of the copyright in content you create and upload merely because you post it on Postsbin.

You retain whatever ownership rights you have in your content, subject to the licenses and permissions you grant Postsbin under our Terms of Service.

The license you grant Postsbin allows us to host, store, reproduce, process, modify for technical purposes, display, distribute, transmit, promote, moderate, and otherwise use your content as reasonably necessary to operate and provide the Postsbin service as described in our Terms of Service.

Technical processing may include resizing, compressing, changing file formats, generating thumbnails or previews, extracting technical information, and making other technical modifications necessary to operate the service.

Copyright Infringement

Copyright infringement may occur when copyrighted material is reproduced, displayed, distributed, performed, adapted, transmitted, or otherwise used without authorization from the copyright owner and without another lawful basis for doing so.

DMCA Copyright Notice Requirements

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of those works.
  3. Identification of the material that you claim is infringing or is the subject of infringing activity, together with information reasonably sufficient to permit Postsbin to locate the material.
  4. Information reasonably sufficient to permit Postsbin to contact you, such as your address, telephone number, and, if available, email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner's agent, or the law.
  6. A statement that the information in your notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Identifying the Content

Please provide enough information for Postsbin to locate the allegedly infringing content.

Whenever possible, include:

General statements such as "this user stole my content" may not provide enough information for us to identify the material at issue.

What Happens After We Receive a Notice

When Postsbin receives a copyright infringement notice, we may review the notice and the content identified in it.

Where appropriate, Postsbin may:

Removal of content does not necessarily mean that Postsbin has made a final legal determination that copyright infringement occurred.

Notification to the User

When content is removed or disabled because of a copyright complaint, Postsbin may notify the user who posted the content.

That notification may include information about the copyright complaint and information about available procedures for responding to the complaint.

Information contained in a copyright complaint may be shared with the user whose content is affected where appropriate or required for processing the complaint.

Counter-Notifications

If your content was removed or disabled as a result of a DMCA copyright notification and you believe the material was removed or disabled because of mistake or misidentification, you may be able to submit a counter-notification as permitted by applicable law.

A valid DMCA counter-notification generally must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed or to which access was disabled and the location where the material appeared before it was removed or disabled;
  3. a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
  4. your name, address, and telephone number; and
  5. the statements regarding consent to jurisdiction and acceptance of service of process required by applicable provisions of the DMCA.

Counter-notifications should be submitted to Postsbin's designated copyright agent using the contact information provided in this Copyright Policy.

What Happens After a Counter-Notification

Where required or permitted by applicable law, Postsbin may forward a valid counter-notification to the person who submitted the original copyright complaint.

Under the DMCA process, content may be restored after the applicable statutory period unless the original complaining party informs Postsbin that it has filed an action seeking a court order to restrain the user from engaging in the allegedly infringing activity.

Postsbin may decline to restore content where the content independently violates our Terms of Service, Community Guidelines, or other policies.

Restoration of content does not necessarily require Postsbin to restore a previous boost, distribution level, engagement level, or other activity associated with the content.

Repeat Infringers

Postsbin maintains a policy concerning users who repeatedly infringe copyright.

In appropriate circumstances, Postsbin may restrict, suspend, or terminate accounts belonging to users who are determined to be repeat infringers.

We may consider factors including:

Circumventing Copyright Enforcement

You may not attempt to evade copyright enforcement on Postsbin.

Third-Party Content and Copyright Ownership

A photographer, studio, agency, production company, publisher, employer, artist, author, or another person or organization may own or control rights in content.

Users are responsible for ensuring that they have appropriate rights or permissions before uploading professionally produced or third-party content to Postsbin.

Music and Audio in Content

Uploading content to Postsbin does not automatically give you permission to use copyrighted music or other copyrighted audio contained in that content.

Users are responsible for obtaining any rights, licenses, or permissions required for music, sound recordings, musical compositions, performances, or other audio included in their content unless the use is otherwise permitted by law or expressly authorized through functionality provided by Postsbin.

The fact that music or other copyrighted audio is included incidentally or in the background does not necessarily mean that it may lawfully be uploaded or distributed.

Postsbin may mute, restrict, disable, stop distributing, or remove content containing unauthorized copyrighted music or audio.

Content Found Elsewhere Online

The fact that content or another copyrighted work is publicly available on the internet does not necessarily mean that it is free to copy, download, reproduce, or upload to Postsbin.

You should not assume that content is available for unrestricted use merely because it appears on:

Before reposting content created by another person, you are responsible for determining whether you have permission or another lawful basis to use it.

External Links and Copyright

Content on Postsbin may contain links to external websites or other online services.

Providing a link to another website does not by itself give you ownership of content available through that website.

You may not knowingly use Postsbin to direct users to pirated content, unauthorized downloads, or services primarily intended to facilitate copyright infringement.

Copyright and Boosted Posts

Boosted posts are subject to the same copyright requirements as all other Postsbin content.

Paying to boost a post does not give you any additional rights to copyrighted material contained in that post.

A post being accepted or approved for boosting does not mean that Postsbin has verified that the user owns or has permission to use all intellectual property associated with that content.

Users remain solely responsible for ensuring that boosted content does not infringe copyright or other intellectual property rights.

Postsbin may immediately pause, stop, restrict, or terminate distribution of a boosted post if we receive a valid copyright complaint or otherwise determine that the content violates our policies.

Trademark and Other Intellectual Property

This Copyright Policy primarily addresses copyright.

Complaints involving trademarks, counterfeit goods, rights of publicity, impersonation, or other intellectual property rights may be handled under separate Postsbin policies or reporting procedures.

Preservation and Disclosure of Information

Postsbin may preserve information relating to copyright complaints, counter-notifications, removed content, account enforcement, and repeat infringement where reasonably necessary for legal compliance, dispute resolution, enforcement of our policies, protection of our legal rights, or other legitimate purposes described in our Privacy Policy.

We may disclose information where required by applicable law, legal process, court order, or other valid legal request.

Information submitted in a copyright complaint or counter-notification may also be provided to the opposing party where reasonably necessary to administer the applicable copyright process or where otherwise required or permitted by law.

International Copyright Complaints

Postsbin is a global platform and copyright laws differ between countries.

Although our DMCA procedures are designed to address claims under United States copyright law, Postsbin may also review copyright complaints submitted under the laws of other jurisdictions.

We may remove or restrict content where required by applicable law or where we determine that the content violates our policies.
